In case of violation of traffic rules by a motorist, a traffic police inspector draws up a protocol on an administrative offense. The form of this document was approved by order of the FAS Russia No. 415 dated October 21, 2008 and is its attachment. Step 1
In the upper right corner of the protocol, write the personal data of the motorist who violated the traffic rules, the address of his registration in accordance with the passport presented to him. Give the document a serial number, the date of the incident, as well as the place where the protocol is drawn up. And indicate the exact place. For example, the village of Sloboda, Gorokhovetsky district, Vladimir region.
Step 2
Then write your full personal data, position. This column contains information about the person who draws up the protocol on the administrative offense. After that, re-enter the details of the person against whom the case will subsequently be initiated.
Step 3
Now write in full the address where the event took place, the exact time. Describe the situation that caused the consequences. For example, in the village of Sloboda, Gorokhovetsky district, at 21:45, citizen Ivanov exceeded the speed limit by 15 kilometers. Then, referring to the norms of the Code of Administrative Offenses, indicate the type of liability that must be applied to this person. For example, a penalty of five hundred rubles.
Step 4
Pass the protocol to the intruder. In the appropriate box, they are written explanations in relation to the charges brought against them. A signature is put, personal data are indicated in accordance with the passport, driver's license.
Step 5
Explain to the offender his rights, obligations, ask to sign in the appropriate field. Familiarize yourself with the protocol of the motorist drawn up against receipt.
Step 6
If the motorist refuses to sign the protocol, make a note of this fact. Then put your signature, the date of the document. Decipher the signature, indicating your last name, initials.
Step 7
Please note that the protocol is drawn up as a carbon copy. Give a copy of the protocol on an administrative offense to the offender, ask him to sign in receipt of the document.
