The article offers a sample application to the management company, in which the new owner of the residential premises asks to exclude from his personal account the debt for housing services that had not previously been paid by the previous owner of the residential premises.
In the daily life of the owners of residential premises, there are often situations when, when they acquire apartments, the management companies arbitrarily, not based on the requirements of the current legislation, shift the debts of the previous owners onto them.
In these situations, it is advisable to write a corresponding statement to the management company.
The content of this statement is as follows:
1) introductory part:
- the name of the organization, its location and full name are indicated in the upper right corner. the official where the application is sent;
- the full name is indicated below. the applicant and his address;
2) descriptive and motivational part:
- the word "Application" is indicated in the center of the page;
- further, the background of the application is described (the conclusion of the sale and purchase agreement of the apartment and the full name of its previous owner, the date of issue of the certificate of state registration of the right, previous oral appeals to the management company about the exclusion of the previous owner's debts from the personal account for housing services);
- then references are made to the norms of legislation, the content of the apartment sale and purchase agreement and other documents (for example, an extract from the personal account), which confirm the obligation to pay for residential premises and utilities only from the moment the ownership of such premises arises, as well as no obligation to pay the debt of the previous owner based on the terms of the concluded agreement;
- disagreement with the debts of the previous owner included in the personal account is summarized and the obligation of the management company to collect debts on mandatory payments from the previous owner of the dwelling is indicated;
3) the pleading part:
- specifies the requirements for the exclusion from the personal account of the debt for housing services of the previous owner and the prevention of their inclusion in the future;
- a reminder of the management company is prescribed about the need to give a written answer within 10 days to this statement, as well as about the possibility of contacting the regulatory and supervisory or judicial authorities.
Copies of documents confirming the applicant's arguments are attached to the application.
At the end of the application, a date is stamped and signed by the applicant.
