Step 1
Submit a statement of claim to the magistrate court at the place of registration of the defendant. By following the rules, you can write this document yourself.
Step 2
You can draw up a statement of claim in writing by hand on an A4 sheet. In the upper right corner, write the name of the court. Address your application to the judge who will hear your case. Indicate information about the plaintiff, that is, about yourself - your last name, first name, patronymic, residence (registration) address. Please enter the same data on the respondent below. After the "cap" write the word "statement".
Step 3
In the body of the application, state the essence of the claim in several sentences. For example, if you were flooded with neighbors from above, and you, unable to agree peacefully, filed a lawsuit in the magistrate's court, indicate when and under what circumstances the event happened.
Step 4
State your requirements against the defendant in writing, referring to applicable laws. For example, when you flood, you need to indicate what damage was caused to you as a result of the negligence of your neighbors on top.
Step 5
Write about the circumstances on which you base your claims, and provide evidence to support these circumstances. For example, a damaged apartment renovation may be indicated as evidence. But it is necessary to attach an apartment inspection certificate drawn up by an official appraiser and signed in front of witnesses.
Step 6
Indicate the amount of the claim if the reason for going to court was a pecuniary dispute. In the considered case, you need to write how much the restoration of the apartment is estimated at. To confirm, you need documents, for example, an estimate for repairs.
Step 7
List the documents that you attach to the statement of claim. There must be a copy of the application, it is sent to the defendant. Receipt for payment of state duty. Documents confirming the claims stated in the claim. In the event of a monetary dispute, there must be a calculation of the amount recovered.
