In any family, there are various situations in which you may need to draw up documents for eviction in court. But correctly writing an application to evict someone from an apartment is not as difficult as it might seem at first glance. If you are evicted, do not despair - experts will solve your problems.
Instructions
Step 1
Eviction through the court is subject to citizens who voluntarily did not want to be removed from the register, hindering by their actions the legal owners of the premises. Therefore, before filing an application, make a list of claims and collect the necessary evidence so that the court has grounds to initiate a civil eviction case.
Step 2
If possible, use the services of a notary or lawyer. Before going to court, contact the registry office, justice department, BTI and the passport office at your place of residence to collect the following documents:
- certificate F-9 on the presence of registration of the evicted citizen (defendant);
- certificate F-9 on registration of the plaintiff (plaintiffs);
- certificate F-7 on the technical condition of the dwelling;
- agreements, contracts, other obligations of the parties;
- documents proving family relations;
- receipt of payment of state duty.
Step 3
On the basis of these documents, lawyers in the future will be able to establish the history of the settling of a citizen, the details and circumstances of the case. Attach evidence to the application, on the basis of which the statement of claim for eviction will have to be drawn up.
Step 4
The application must be drawn up at the place of registration of the evicted citizen. In the application, be sure to indicate information about his current place of residence and a new address, on the basis of which an extract will be issued at the passport office.
Step 5
If an eviction is being filed against you, prepare for a court hearing by collecting the following documents:
- F-9 certificate of registration;
- certificate F-7 on the technical condition of the dwelling;
- agreements, contracts, other obligations of the parties;
- documents proving family relations;
- other documents related to the case under consideration.
