Relationships between people consist of interests; in some cases, interests diverge, giving rise to disputes and conflicts. The duties of judges include resolving conflicts in accordance with the law. In addition, the court performs a punitive and law enforcement role, since the state must protect the rights and freedom of its citizens. But, unfortunately, professional incompetence and mistakes of judges have become the norm in our time.
Instructions
Step 1
According to the Constitution, one of the branches of government is the judiciary. Every citizen is guaranteed the protection of rights and freedoms. Inaction or action of any government body, public association or official can be challenged in court. It is impossible to overestimate the role of the court in regulating public relations.
Step 2
In order for judges to make objective and impartial decisions, and so that no one can influence the decisions made, the law provides judges with guarantees of immunity and independence. However, immunity is not absolute.
Step 3
Unfortunately, the judge sometimes turns out to be interested in the end result of the resolution of a legal proceeding. And instead of protecting the interests of the victim, he violates his rights, guided not by the law, but by personal interests or selfish considerations.
Step 4
In this case, the judge must be held accountable. The powers of a judge may be suspended or terminated only on the grounds established by law. A judge can be held criminally liable for a crime committed against a person, for property crimes, as well as for abuse of his powers, taking a bribe, forgery, negligence and deliberately bringing an innocent person to criminal liability. For the commission of a disciplinary offense, a judge may be removed from his powers or given a warning.
Step 5
The Constitution establishes the procedure for bringing judges to justice. For example, in order to bring a judge to criminal responsibility as an accused, a decision of the Attorney General is required, which is made on the basis of the opinion of the judicial collegium. The judicial collegium must consist of 3 judges of a higher court, in addition to this, there must be the consent of the qualification collegium of judges. The decision to impose a disciplinary sanction on a judge is made only by the qualification board. Issues of termination of powers are also considered there.
Step 6
Therefore, first of all, it is necessary to file a complaint with the qualification board. The criminal case is being considered by the Supreme Court.
