In order to pre-trial decide the question of which of the parents the son or daughter will live with, an amicable agreement is drawn up on determining the child's place of residence and the procedure for exercising the parental rights of the parent who lives separately from the child.
Instructions
Step 1
Remember that the agreement on children is drawn up by the parents on a voluntary basis in a simple written form, and is not subject to mandatory notarization, the signature of each parent is enough. This agreement terminates when the child turns 18 or attains full legal capacity earlier. You can also amend or terminate this agreement like any other agreement. The purpose of concluding a child agreement is to respect the interests of the mother, father, and, of course, the child.
Step 2
In the first part of the agreement, identify the child's place of residence. This may be the residence of the father or mother. Depending on who the child will live with, write down in the agreement the procedure for exercising the parental rights of the parent who will live separately. As a rule, the agreement stipulates that parents decide all issues related to education and upbringing, by mutual agreement and taking into account the interests and opinions of the child himself. Equal responsibility for the upbringing and development of the child is also established. However, you can establish segregation of responsibilities in the agreement if you wish.
Step 3
Write down the order of meetings between the child and the parent, who will live separately. Also reflect the responsibility of the parent with whom the child lives to provide the opportunity to meet freely with the father or mother, as well as their relatives. The agreement can prescribe the hours of walking, spending weekends, holidays and vacations with the second parent and his relatives, as well as the opportunity to go to rest homes, resorts, including those outside the Russian Federation.
Step 4
In the paragraph concerning the rights and obligations of the parties, write down that it is the responsibility of the parent with whom the child lives to dress and collect the child (prepare his luggage) for meetings and travel with the second parent. Reflect in the agreement that the parent living separately is obliged to pick up the child at the set time and return it back, in the case of joint trips, prepare comfortable living conditions.
Step 5
Devote the final clauses of the agreement to the obligations of the parties to maintain friendly relations in the presence of the child, not to discuss personal complaints and not express disapproval of each other and towards relatives. Also write down the order of the birthdays of the child and the presence of both parties at these events.
