The order of "sending" employees on annual leave in accordance with Art. 123 of the Labor Code of the Russian Federation is established by the schedule approved by the organization. The employer must notify you of the start date of the vacation no later than two weeks in advance. As a rule, when it comes to shifting the rest period by a few days, the human resources department meets the employee halfway. A flexible approach to determining vacation days and knowing the benefits will help you make rational use of your break from work.
Instructions
Step 1
When planning your vacation, you should take into account that rest days are calculated in calendar days. You will be entitled to 28 such days.
This includes weekends (holidays are an exception). At the same time, you have the right to split the vacation in two. One of them cannot be less than 14 days. This way, you can plan to start your vacation on the day when two weekends are "beyond the end" of the period, and you have two more days of rest.
Step 2
Remember that there are categories of workers whose employer, on the basis of Part 4 of Art. 123 of the Labor Code of the Russian Federation should be sent on vacation at a convenient time for them. This benefit applies to:
- a husband who is entitled to annual leave during the period when his wife is on maternity leave (Article 123 of the Labor Code of the Russian Federation);
- an employee who wants to go on another vacation before the maternity leave prescribed by law, after it or after parental leave;
- a part-time worker who goes on vacation according to the schedule of the main place of work;
- an employee with a child under the age of 18 (as well as a guardian, curator) and accompanying him for admission to a remote educational institution (Article 322 of the Labor Code of the Russian Federation).
Employees who have been awarded the "Honorary Donor of Russia" badge can take leave at a convenient time.
Step 3
On your own initiative and upon written application, you can ask the employer for unpaid leave. This makes it possible to rest on the tour, to make a trip in terms that you cannot change.
Step 4
Remember, 28 days is for both full-time and part-time workers. If you are under 18, you are entitled to an extended leave of 31 calendar days. In case of disability, there is also an increase in 2 calendar days.
Step 5
If you have an irregular working day, you are entitled to additional leave (Article 119 of the Labor Code of the Russian Federation).
Step 6
Review your plant's collective agreement. According to Art. 116 of the Labor Code of the Russian Federation, an organization has the right to provide additional vacations to its employees in excess of those established by law. So, hiring the best specialists, some employers include in the social package a provision for an additional vacation of 7 days. Such vacations can be used in agreement with the management. You can receive compensation for unused additional vacation.
Step 7
The vacation can be postponed to a later date, taking into account your wishes, if you are sick before the start of the vacation.
