The basic annual paid leave is granted to each employee. You can get your first vacation after working for six months. The duration of the vacation is 28 calendar days. A vacation is issued in accordance with the vacation schedule on the basis of the Order. The amount of vacation pay is calculated from the average earnings and the number of vacation days.
Instructions
Step 1
To pay for the due vacation or to pay compensation for unused vacation, the average daily earnings for the last year, that is, 12 months, are calculated. To do this, divide the amount of the accrued salary by 12. Divide the total by the average monthly number of calendar days, which is 29.4. Persons who work part-time are granted leave together with leave from their main job. In the event that the employee has not yet worked 6 months, you can provide an advance leave.
Step 2
The length of service, which gives the right to paid leave, includes the time of actual work, as well as time outside of work, that is, weekends and holidays. Weekends and holidays are not paid, unlike paid leave, but work on such days is compensated by increased pay or the provision of other rest time that is not paid. When measuring part of the vacation with monetary compensation and when working on holidays, the employee loses the right to uninterrupted rest, but in return gets the opportunity to work.
Step 3
The employee receives monetary compensation for the vacation when part of the vacation is replaced, since vacation is a paid time of rest. That is, if the employee refused to use the vacation, he received the same remuneration that would have been paid while on vacation. In this regard, compensation for unused vacation is not recognized as compensation for waiver of the right to vacation. However, according to the law, payment for work on holidays and holidays must be paid in a larger amount. For the purpose of rational use of holidays and weekends, the Government has the right to postpone the weekend to other days.
Step 4
The length of the vacation varies depending on whether the holiday falls within the vacation period. The duration of the vacation is not limited by the maximum limit, holidays that fall into the vacation period cannot be included in the calendar days of the vacation. For example, an employee was on vacation from August 2 to August 15, and Saturday August 7 is postponed to another working day - Friday August 13, since August 12 is a holiday, and it falls on Thursday. That is, one day falls on the employee's vacation period - August 12, which is a holiday and is not included in the calendar vacation. Although the employee is on vacation for 14 calendar days, the number of vacation days is 13. The day that has been rescheduled cannot affect the duration of the vacation. In fact, the employee will be absent for 14 days, but only used for 13 days. Therefore, 13 days of vacation are paid.
