The Labor Code of the Russian Federation regulates the procedure for paying for the performance of duties by specialists of companies, employees of individual entrepreneurs during the New Year holidays. The amount of remuneration is calculated in accordance with the labor, collective agreement or other local act in force at the enterprise. Salaries for employees for work on holidays are calculated at double the rate, but this applies to those professionals who receive a salary. This norm does not apply to the remuneration of pieceworkers.

Step 1

When hiring specialists for a position, prescribe the procedure for remuneration on holidays (weekends) in the contract. If you did not take this into account when concluding an employment contract, draw up a collective agreement. Write down the amount of remuneration paid to employees for work during the New Year holidays. Consider the opinion of the chairman of the trade union organization, if there is one in the company. Familiarize the specialists with the local act against receipt.

Step 2

In the case of a piece-rate form of remuneration, calculate the amount of wages for performing duties during the New Year holidays in the same sequence as the remuneration for performing labor functions on working days is calculated. If the collective agreement stipulates that such employees are paid a bonus for work on holidays, multiply the number of products by the wage rate, add the amount of the additional payment. Give money to employees.

Step 3

With time-based wages, the amount of remuneration depends on the established norms. If the work takes place during the New Year holidays, double the wages for the holidays. When the labor function is performed on the due weekend, it is obtained within the monthly norm, pay in accordance with the staffing table.

Step 4

The legislation establishes that it is not allowed to reduce earnings for the New Year holidays, as this would be a direct violation of the rights of employees. It is possible to call for work on holidays only if the normal further activities of the enterprise depend on the exit of a specialist. Article 113 of the Labor Code of the Russian Federation lists other situations in which it is allowed to involve employees in work on weekends.

Step 5

If the employee's vacation falls on New Year's holidays, extend the employee's vacation by the number of days off. Please note that if you call a specialist to work on a holiday, you need to get his written consent, since the legislator has provided for punishment for violating the norms of the Labor Code of the Russian Federation.
