In January, there are a lot of non-working all-Russian holidays - this is the 1st, 2nd, 3rd, 4th, 5th and 7th (Article No. 112 of the Labor Code of the Russian Federation). If one or several days fell on Sunday, the New Year holidays are significantly lengthened. Regardless of this, wages must be accrued and paid in full. If on the indicated days employees were involved in work due to a production need or in connection with a continuous production process, the payment is doubled.

Step 1

A continuous production process cannot be stopped. If your company is working on a shift schedule in a continuous mode, pay for all worked holidays in double the amount. At the request of a working employee, you have the right to provide an additional day off for work on holidays. In this case, pay in a single amount, the day off is not subject to payment.

Step 2

Employees who do not have a shift schedule can be recruited to work on non-working all-Russian holidays only with written consent (Article 153 of the Labor Code of the Russian Federation). Inform them in writing about the production need, in connection with which you need to work on holidays, get written consent, issue an order indicating everyone who will go to work. Pay also double the amount or provide additional days off if the employee has expressed a personal desire and notified you in writing.

Step 3

For all other employees who were vacationing during the New Year holidays, pay the salary in accordance with the days actually worked in January, multiplied by the average daily salary in the billing period. To calculate the average daily salary, divide by the number of working days in January. If the employee was not on sick leave, did not take time off, pay him the salary in full, as for all other months in which there are no national holidays.

Due to the large number of non-working days, the jobseekers significantly lose their wages, but according to article No. 112 of the Labor Code of the Russian Federation, this should not happen, therefore the employer is obliged to pay additional remuneration for January in accordance with the regulations of the company's internal regulations. The January salary of pieceworkers must not be lower than the average piecework earnings for 12 months.
