Driving to suicide belongs to the category of crimes of average gravity. The punishment is from three to five years in prison. A person who has reached the age of 16 can be found guilty, provided that he is responsible.
Threats, ill-treatment and / or constant humiliation of human dignity are considered legal grounds that provoke a person to commit suicide or an attempt to commit it. Thus, incitement to suicide can be carried out by the subject both intentionally and unconsciously. In any case, it is required to consider and confirm the presence of a causal factor. It is rather difficult to prove that certain actions of the subject led to the suicide of another person. But, since such cases occur from time to time in criminal practice, this is possible.
The main object of the investigation is the behavior of the accused and the indirect or direct threat posed by him, including driving him to suicide by negligence. As a rule, the actions of the accused are characterized by constancy and regularity. Even if the process of driving to suicide was carried out intentionally, there is no fact of murder. Article 110 of the Criminal Code of the Russian Federation differs in that the consequences of the crime committed come from the actions of the victim himself. The subject is guilty only of the pressure, which became the reason for the subject to take his own life.
Methods of committing a crime
It is possible to bring to suicide both by action and by inaction. The group of actions includes threats, abuse and humiliation of human dignity. Inaction is expressed in obvious indifference to the actions of the victim, for example, refusal of food and water goes "unnoticed".
Threats. It is not the threat itself that plays a role here, but its subjective perception by the victims as representing a danger. Due to age, mental, social status characteristics, a situation normal for one is perceived by another as critical. It concerns both serious threats and not so much - the constant maintenance of a person in tension is fraught with the creation of an illusion of hopelessness in him.
Cruel treatment. A concept that needs an objective assessment. Ill-treatment refers to acts that result in the infliction of physical and / or mental suffering on the victim. The main indicators for assessment are the degree of rudeness and ruthlessness.
Systematic humiliation of human dignity. This is not about assault. Humiliation can be expressed by slander in relation to the victim, his constant harassment or mockery, repeated insults, unfair criticism, etc. Elementary yard gossip can make a person jump from a roof.
