Periodically, the Ministry of Health and Social Development of Russia, by its orders, establishes standards for the free issuance of overalls and footwear for employees whose professional duties are related to harmful and dangerous working conditions or performance of work in uncomfortable conditions, for example, at low temperatures. Therefore, many have the mistaken opinion that only the specified categories of workers are entitled to free overalls.

Article 211 of the Labor Code of the Russian Federation states that any types of activity must be carried out in strict accordance with labor protection requirements. There are lists of professions for which norms for the issuance of special clothing, footwear are established, and they provide for the issuance of overalls and footwear for many workers employed in various sectors of the economy, including employees of credit organizations, book trade, cultural organizations, universities.

So, for example, bank employees are subject to the standard approved by the Decree of the Ministry of Labor of Russia No. 63 of August 30, 2000. For communication workers, government organizations, printing production and book trade, organizations of the Russian Academy of Sciences, the standards established by the Decree of the Ministry of Labor of Russia No. 63 of 16 December 1997 And the decree of this ministry 66 of December 25, 1997 regulates the norms of work clothes for employees of universities, cultural organizations, those who are engaged in the production of musical instruments and the production of fountain pens.

In some cases, in order to find the required standard, you should carefully read the standard standards that are approved by orders of the Ministry of Health and Social Development. So for air transport guards, the standard for issuing uniforms is set in clause 70, and for a loader - in clause 58. At the same time, the standards are differentiated for different climatic zones and for special working conditions.

Overalls should correspond to the individual characteristics of the employee, his size, gender and age.

Is it possible to change the norms

The employer has the right to change the norms for the issuance of overalls, but only upward. To avoid disputes with the tax authorities, about the limits on the cost of personal protective equipment and workwear taken into account when calculating income tax, these norms must be approved by a separate order, spelled out in a collective agreement or in an agreement on labor protection. In these documents, it will be necessary to legalize not only the issuance of clothing in excess of the established norms, but also its issuance to those categories of workers who are not specified in the industry standard standards.
