If one of the parties to the contract violates its terms by improperly providing a service or selling low quality goods, the injured party can file a claim against the violator and compensate for the damage caused.
What is a claim?
A claim is a statement by the client about violations of the terms of the contract in relation to the purchased product or provided service. A paper claim is a good way to improve the relationship between the seller and the buyer, or the customer and the contractor, without going to court. A well-written claim plays an important role. It is a good method of resolving the emerging contradictions between the parties to any civil contract.
Drawing up a requirement
1. A claim is handwritten or printed on a computer.
2. The focus of the claim. The complaint is presented not to a specific seller who sold the goods, and not to a specific worker of the company who provided a low-quality service - it is provided to a legal entity or an individual entrepreneur.
3. From whom the complaint is. In the claim, the injured party indicates information about himself: full name, place of residence, as well as a phone number.
4. The title indicates the name of the text that is drawn up: a claim or a statement.
5. The essence of the problem is stated directly in the text:
- the date and place of the purchase of the goods or the provision of the service is indicated.
- the claim contains the exact data of the product or service: name, article, parameters, model, serial number, etc.
- indicates whether there is or is not a warranty period for the product or service.
- a description of the problem itself.
6. Clear formulation of your requirements. They are formulated as accurately as possible and in accordance with the current legislation of the Russian Federation. These can be: a refund, a request to eliminate a deficiency, compensate for losses, etc.
7. At the end of the complaint, it is indicated what you plan to do if the requirements are not voluntarily satisfied.
8. Date and signature.
9. The complaint is written in 2 copies, or a photocopy is made.
10. The first copy (original) is given to the addressee, and on the second copy (copy) the addressee's employee puts his signature, full name, position and incoming registration number.
11. The written claim must be accompanied by:
- a copy of the sales (cash) receipt;
- a copy of the warranty card;
- copies of acts, contracts, certificates and other documents available in connection with your claim.
12. The claim is handed over to the addressee.
