Owner's rights to visit the rented apartment

The owner of the dwelling, like the tenant, after the conclusion of the lease of the dwelling is obliged to act in accordance with Article 671 of the Civil Code of the Russian Federation. It states that the owner transfers the dwelling into the possession of another civilian and resides in it for a fee. Thus, the tenant also becomes a kind of owner of the premises, but cannot make transactions with it, carry out planning and has a ban on some other actions.

Since the tenant uses the apartment to live legally, he has the right not to let any unauthorized persons into it. In addition, the tenant's personal belongings are placed in the premises, other persons may live in accordance with the concluded lease agreement. Therefore, if it is necessary to visit the apartment, the owner is obliged to warn the tenant about this in advance so as not to violate his personal and legal space and, moreover, to touch his personal belongings without permission. These actions are also contrary to ethical norms.

Some exceptions

Usually, the moment the owner visits the apartment is additionally negotiated in the lease agreement. If it states that the owner has the right to come to his home at any time, he will be able to use it even without warning the tenant, and the latter should take this into account. Also, the owner of the premises has the right to enter it in case of emergency, such as reporting a burglary, a fire, an emergency, etc.

In addition, it is important for the tenant to remember the need to comply with all clauses of the lease agreement, especially regarding the timing and amount of payment for the lease. This also includes any actions that contradict the agreement or lead to damage to the property transferred for use. If any rights are violated, the concluded agreement will be considered invalid, and the owner has every right to visit the apartment, including with the participation of police officers to evict the persons living here and compensate them for the losses caused.
