A huge number of men in our country avoid paying alimony in all possible ways. One of them is the deliberate job search with informal earnings. But there are people who are ready to take responsibility and pay, on the contrary, more in the conditions of “black wages”. Lawyers recommend doing this according to an official scheme.
Necessary
- - Conclusion of an agreement on the payment of alimony at a notary
- - Bank details of the account to which the funds will be transferred
Instructions
Step 1
First, convince your spouse that the option of voluntarily transferring alimony is the most beneficial. Sometimes the mutual hostility of the child's parents reaches such limits that it is difficult to conduct civilized negotiations.
Step 2
Visit a notary to sign the support agreement. This practice has existed for a long time and is enshrined in the Family Code, so this specialist has a sample document.
Step 3
Determine the amount of alimony that will be specified in the agreement. The figure, of course, cannot be lower than the one that the parent of the child would have received through the courts. The standard figures in a court decision are one quarter of earnings for one child, one third for two, and half for three or more. There are several rules for determining the amount in an agreement. It can be a share of income, a fixed amount, or even a grant of property.
Step 4
Indicate the frequency of the transfer of the amount. This is not regulated. The parties can decide on their own whether the amount will be paid, for example, once a month or once a quarter.
Step 5
Select the option to receive alimony. Cash can be transferred directly to the recipient. You can pay by postal order or to a bank card. Alimony can be paid even with food, clothing, medicine. It is not uncommon for the father to give the child an apartment, house or car. Assessment of property in this case is carried out by agreement of the parties
Step 6
When paying in cash, be sure to take a receipt. When sending a postal, bank transfer, keep all documents for at least 3 years. Sometimes they may be required as proof of the fact that child support has been paid.
