Instructions

Step 1

Check the code. Determine exactly if a fine can be imposed in this situation. If this is a fine for a tax offense, open the Tax Code. Articles dealing with the imposition of fines are concentrated in chapters eight, fifteen and sixteen. In the Labor Code, this is chapter thirty-nine. Open them and read them carefully.

Step 2

Start with the Internal Revenue Code. Read chapter sixteen. Find the offense that fits the offender's action. Now pick up the Labor Code. Open article thirty-nine, start with the circumstances precluding the employee's financial liability. If something fits, you cannot impose a fine. If none of the above works, skip to the next articles.

Step 3

Find the article you need in the Tax Code. An example is article 119, part one. Calculate the amount of the fine based on the article. Go to the Labor Code. The damage from the employee amounted to one thousand rubles. So the amount of the fine is one thousand rubles. It remains only to collect these fines.

Step 4

Review the Tax Claim Form. In the form, a separate line contains a requirement to pay a fine with an indication of its amount. Submit your tax claim. If the offender refuses to comply with it, in accordance with article forty-six of the Tax Code, it is necessary to foreclose on the funds in the taxpayer's accounts.

Step 5

If they are not enough, then it is necessary, on the basis of article forty-seventh, to collect tax and a fine at the expense of other property. Then there are the problems of the bailiffs. As for the Labor Code, on the basis of article two hundred and forty-eighth, if the amount of the fine does not exceed the amount of earnings, impose a fine by your order. If the employee refuses to comply with the order, the damage is more than his salary, the recovery is carried out by the court. That's all, these are now the problems of the legal adviser and the court.
