A person can be recognized as incompetent only by a court decision. Close relatives, guardianship and guardianship authorities or representatives of the neuropsychiatric department can apply to the court. An application for consideration by the court is not accepted from other persons.

Instructions
Step 1
To recognize a person's incapacity, contact a neuropsychiatric dispensary. Write a statement for a neuropsychiatric examination. Describe in detail the grounds for such an examination and all inappropriate actions of the person.
Step 2
The conclusion about the mental state of a person must be issued by a neuropsychiatric commission. One doctor is not authorized to issue such documents. The conclusion must be stamped with the official seal of the medical institution, signatures and personal stamps of all members of the commission.
Step 3
After receiving a medical opinion, apply to the guardianship and guardianship authorities for the participation of this body in the court session.
Step 4
Write a statement to the court with a detailed description of the current situation, indicating your details and the degree of relationship with the person with whom you need to be declared incapacitated. Attach the conclusion of the neuropsychiatric dispensary.
Step 5
If you cannot get the opinion of the commission, and the person avoids visiting a medical institution, the court will order the commission to be held compulsorily.
Step 6
After a court ruling recognizing a person's incapacity, they will be assigned a guardian or placed in a psychiatric clinic.
Step 7
The guardian must report everything to the guardianship and guardianship authorities. All actions of the guardian in relation to the care, life and health of the ward, as well as the disposal of his money and property, must be coordinated with these authorities.
Step 8
The guardianship and trusteeship authorities will exercise constant control over the person under guardianship and the actions of the guardian.
