Step 1

Claims and other statements within the framework of civil and arbitration proceedings may contain requirements for both one and several defendants. However, the presence of a second defendant may become clear already during the consideration of a civil dispute.

Step 2

Only a court can attract a legal or natural person as a second defendant. A petition to bring a co-defendant can be filed both by the plaintiff and by a person participating in a civil case as a defendant.

Step 3

Such a request is addressed to the judge hearing the case. It is advisable to arrange it in writing. In the application, be sure to indicate the details of the organization or the data of the individual who, in your opinion, should be involved in the process as a co-defendant, and most importantly, of course, justify the reasons for the need to involve the second defendant in the case. They can be, for example, joint provision of services under a contract, partial succession, etc. All your arguments must be documented - ask the court to attach the relevant papers to the case in the petition.

Step 4

You can submit the petition in person to the judge during the court session on the case or in the interval between sessions - through the court registry. In the latter case, do not forget to indicate in the application the case numbers, the name of the judge and the names of the parties to the case.
