Everyone has the right to dispose of their own property at their own discretion. Including - to bequeath it to any individuals and legal entities. This statement also applies to cash deposits. If it happens that someone has inherited their money in your bank account, get it following the guidelines below.
Instructions
Step 1
Find out the date of drawing up the will - before March 1, 2002 it was signed or after - the algorithm of your further actions will depend on this. The fact is that since March 2002, the Civil Code began to operate on the territory of the Russian Federation, equating bank deposits with all other inherited property. But if the will was drawn up before this date, you will be able to receive money according to the norms of the old legislation.
Step 2
Apply to receive the money bequeathed before 2002-01-03 to the bank branch where the deposit was opened. Take with you:
- your passport;
- death certificate of the person who left you an inheritance (original and copy);
- the passbook of the deceased (if you do not have a passbook, write a statement about its loss at the bank branch).
Step 3
Please note that if the will was signed not at the bank branch, but at the notary's office, you will need to present the will itself to the bank employees. Moreover, on the document it will be necessary to preliminarily put a notary's mark that the deceased did not leave any other testamentary orders on this contribution.
Step 4
Receive the money bequeathed to you. In case of problems, contact the bank's management and / or the court.
Step 5
Enter into inheritance rights if you want to receive money under a will made after 2002-01-03. To do this, within 6 months from the date of death of the testator, contact a notary with a corresponding statement.
Step 6
Obtain a certificate of your inheritance right from a notary. Please note that even before receiving the certificate, you can withdraw money from the deceased's account to organize his funeral in the amount of no more than 200 minimum wages.
Step 7
Contact the bank branch where the deposit was opened. Take with you:
- your passport;
- certificate of the right to inherit by will;
- the savings book of the deceased (if any).
Step 8
Receive the amount of the bequeathed deposit. Or, in case of problems, contact the bank's management and / or the court.
