Step 1

If the apartment is in your ownership, then your husband's right to use it terminates immediately after he officially ceases to be considered a member of the owner's family. Try to evict him from the apartment so as not to pay utility bills for him. But you can only do this if he has another place to live. If he refused to participate in the privatization when the rights to the municipal apartment passed into your ownership, you also cannot evict him or deregister him.

For an apartment owned by both former spouses, in accordance with Article 210 of the Civil Code of the Russian Federation, they bear equal financial responsibility for maintenance. In the event that the second owner refuses to spend money on the maintenance of his property, you can force your ex-husband to pay for the apartment by going to court. You have a chance to get back a part of the utility bills equal to his share in the apartment. But keep in mind that the limitation period is limited to three years. Write a statement of claim and attach a copy of the payment receipts that you made in full yourself.

Step 3

To oblige your ex-husband to pay the rent, split your account with him. In this case, he will be personally liable for non-payment of utility bills. Submit a statement of claim with a request to divide the personal account to the court. Ask the court to oblige the management company to allocate this account to your ex-husband, according to his share in the privatized apartment.

Step 4

A former spouse who continues to live in a residential building under a social tenancy agreement, in accordance with clause 4 of article 69 of the Housing Code of the Russian Federation, is independently responsible for his obligations. The landlord or tenant must enter into a separate agreement with him that determines the procedure and amount of his participation in the costs of housing maintenance. In case of refusal, all issues related to the division of responsibility are resolved through the court.
