Drinking any alcohol in public places is considered an administrative offense. Responsibility for committing such a violation is established by Article 20.20 of the Code of Administrative Offenses of the Russian Federation. The sanctions for citizens are minimal, they are purely financial in nature, and consist in the imposition of a fine in the range of 500-1500 rubles. It should be noted that a much higher degree of responsibility is established for drug use in the same places, since this violation is characterized by an increased danger to society.

What places are considered public?

To prosecute for drinking alcohol in a public place, it is necessary to determine the range of such places. It is disclosed in article 16 of the Federal Law of 22.11.1995 No. 171-FZ. In particular, public places are staircases, elevators, entrances, staircases, playgrounds, courtyards, parks and some other areas. At the same time, the aforementioned norm specifically stipulates that it is not an offense to drink alcohol on the territory of public catering organizations, since they can be located in public places, sell alcoholic beverages, including draft. The legislation does not contain other exceptions, therefore, when consuming any alcohol within public places, a person runs the risk of being subjected to administrative punishment.

How to avoid prosecution?

In most cases, you can avoid punishment for consuming alcohol in a public place by visiting catering organizations. Special exceptions are legally established for them, therefore, when alcohol is consumed on their territory, no one is brought to justice. For example, the drinking of alcoholic beverages in cultural institutions is prohibited, since this is directly indicated in the law, these institutions are also public places. But in most theaters, there are catering points, buffets in which alcohol is sold to everyone. The consumption of alcoholic beverages on the territory of such buffets will not be considered an administrative offense. A similar rule applies to many other institutions, organizations related to public places.
