Twenty years ago, a dacha for most Russians was associated with several hundred square meters of land for a vegetable garden, in the middle of which a one-story house without any amenities rose, in which the happy owner could even live in the summer. Today, summer cottages and garden plots are more often used not for fulfilling the food program, as during Soviet times, but for the construction of country houses designed for comfortable living at any time of the year. Therefore, the question of the possibility of permanent registration in such a house is especially acute.
Why do you need permanent registration at the dacha
According to Article 1 of the Federal Law of April 15, 1998 No. 66-FZ, buildings erected on plots intended for gardening, truck farming and summer cottages were simply classified as residential buildings, permanent registration in which was prohibited. However, for those citizens who actually lived in their summer cottages or garden plots far from the place of permanent registration, this created certain inconveniences, violating, among other things, their constitutional right to receive medical care, pension or education. After all, many social benefits and services are provided at the place of permanent registration. In addition, the ability to register at the dacha allows you to significantly save on utility bills.
In the fall of 2013, amendments to the legislation were adopted, according to which the vague term “residential building” can be replaced with a very specific definition of “individual residential building”. And living in such a house implies the possibility of obtaining permanent registration at its address. Now, in order to obtain a residence permit, or permanent registration, at a summer cottage, it is necessary that your summer cottage be recognized as an individual residential building.
What is required for a residential building to be recognized as an individual residential building
An assessment of how comfortable the house, erected on a summer cottage or garden plot, is, how much it is adapted for year-round living in it, should be made by a special commission. It includes representatives of several departments, whose territory of responsibility includes the location of your summer cottage. It includes representatives of the fire service, Rospotrebnadzor bodies, BTI, and other officials of this municipal executive body. You, as an owner, can also participate in the work of this commission, although your vote will be advisory.
You need to submit the following documents to the interdepartmental commission:
- an application for the recognition of a dacha residential building as an individual residential building;
- copies and originals of documents confirming the ownership of the house and land plot;
- floor-by-floor technical plan of the building, issued by the BTI.
The decision to transfer the country house to the category of "individual residential building" must be made by the commission within 30 days. The main criteria by which the house is recognized as suitable for permanent residence are the availability of water supply and sewerage.
