If there is a dispute, then the document that you bring to court should be called a statement of claim. The requirements for the preparation of this document are set out in the procedural legislation, namely in the Code of Civil Procedure of the Russian Federation.
Instructions
Step 1
Decide which court you will go to. Check in court or consult with a lawyer about how to file civil claims in court. Make a civil claim in an arbitrary, but always in writing and with an indication of the court to which you are applying. Identify the complainant, his place of residence, or the location of the organization if you are acting on its behalf. You must provide the same information about the defendant.
Step 2
Describe in detail the violation of your rights, legitimate interests or freedoms, as well as the circumstances on the basis of which you justify your claims. Indicate the evidence you have in your civil action. Indicate the price of the civil claim (if it is subject to assessment), as well as the calculation of the amount that you want to dispute or recover. According to the legislation of the Russian Federation, you must attach copies of this claim to a civil claim (the number of copies corresponds to the number of defendants and third parties), a document confirming the payment of state fees and documents on the basis of which you compiled civilians (copies are also sent to the defendants and third parties).
Step 3
Start your lawsuit by describing the events leading up to the conflict in chronological order. Describe the situation in as much detail as possible, every detail can be crucial when conducting court hearings. Emphasize the connection between events, do not jump from event to event: if you started describing one thing, finish the story about it, then move on to the next.
Step 4
Start describing each new event with a paragraph. Don't rely on laws in your civil lawsuit, state the matter and state your requirements. Sign your statement of claim and file it in court. Within 5 days, the judge considers the claim and makes a decision on accepting it for proceedings.
